I've been through something similar and it's really frustrating 😅 The deductible is usually charged regardless of fault, but you have the right to contact the other driver's insurance to recover that amount - they should compensate you for the damage. If the other car fled or you don't have their information, then it gets trickier and your insurance covers it according to your policy. It's worth reviewing your contract to see if there's any special clause for third-party cases, and if you feel it's really unfair, file a complaint with Susep (the agency that oversees insurance companies) because they tend to be pretty quick at resolving things.
